Duterte’s terror list another step towards martial rule–A joint statement of concern of Hong Kong-based civil society organisations, human rights and peace advocates
聯署聲明︰譴責杜特爾特公布恐怖份子名單!反對軍事統治!香港民間社會關注菲律賓人權狀況的聯合聲明

The Hong Kong Campaign for the Advancement of Human Rights and Peace in the Philippines (HKCAHRPP) together with the undersigned organisations and human rights and peace advocates, denounce the fake terror listing of more than 600 persons, human rights defenders and critics of the Duterte government in the proscription petition filed by the Department of Justice (DOJ), through Senior Assistant State Prosecutor Peter Ong, at a regional court in Manila on February 21, 2018. The petition not only seeks to declare the Communist Party of the Philippines-New People’s Army (CPP-NPA) as terrorist organizations but also named individuals as their supposed leaders or members, including those who are dead, missing and members of paramilitary units accused of killing Lumads in Mindanao.
This is a brazen and malicious attack of the Duterte government against leaders of progressives and patriotic organizations and revolutionary forces who opted not to be silenced against the anti-people policies and dubious campaign of Pres. Duterte’s against illegal drugs and corruptions. The petition filed at the regional trial court is but an attempt to sow fear among the Duterte critics and another step towards the ambiguous effort of the Duterte government to put the entire Philippines under Martial Law.
It remains fresh from the Filipinos psyche and experience during the time of Arroyo and Aquino regime that members and leaders of progressive organizations, human rights and peace advocates, political activists who are put in the order of battle (OB) by the military are charged with trumped-up charges, detained, tortured and even killed. Such list as a rehash from the previous regimes will only intensifies and worsens the state of human rights violations in the country whose target are political dissenters and communities who raised legitimate issues like land reform, environmental protection, contractualization among others.
Among the personalities and progressive individuals in the fake terror list of the Duterte government is Ms. Victoria Tauli Corpuz, UN Special Rapporteur on the rights of indigenous peoples and former Chair of the UN Permanent Forum on Indigenous Issues. Miss Corpuz to be included in the list is a clear case of reprisal from Malacanang for she expressed concern over possible cases of human rights violations due to the imposition of martial law in Mindanao.
Also included in the fake terror list are notable leaders of indigenous people’s organizations who are active in fighting for ancestral domain and the right for self-determination of the indigenous people like Joan Carling, Atty. Jose Molintas, Beverly Longid, Joanna Cariño and Wendell Bolinget and at least 10 Lumad datu/leaders in Northern and Southern Mindanao. These personalities and their commitment for the cause and struggle of indigenous people are not only recognized by people in many communities whom they help to be empowered but moreover at the regional and international formations like the UN Permanent Forum for Indigenous Issues and International Indigenous Peoples Movement for Self-Determination and Liberation (IPMSDL).
Worse, the fake terror list and the filing against CPP-NPA as terrorist organization at the regional trial court expose the real intention of the Duterte government in the peace negotiation. By putting members of NDFP Peace Panel like Coni Ledesma, Julie de Lima, Benito and Wilma Tiamzon and 20 other peace consultant and former Bayan Muna Rep. Satur Ocampo, only prove that Duterte government’s agenda for peace is but capitulation contrary to the intention of peace talks which is to address the root causes of armed struggle in the Philippines and fulfill the aspiration of Filipino people for land, jobs, justice and human rights.
Thus, we the undersigned together with the Filipino people are calling on the Duterte government to stop sowing fear to silence the Filipinos through the terror listing. Listen to their legitimate demands for land, jobs, justice and human rights instead. The Filipino people will not raise their fist and criticize the government if their legitimate demands are being met, their human rights are being respected and they see no sign that the present government is moving towards tyranny and dictatorship.

譴責杜特爾特公布恐怖份子名單!反對軍事統治!香港民間社會關注菲律賓人權狀況的聯合聲明
The Hong Kong Campaign for the Advancement of Human Rights and Peace in the Philippines(香港關注菲律賓人權及和平運動的平台)與下列聯署聲明的組織,人權與和平倡導者,一同譴責虛假的恐怖分子名單。杜特爾特近日公布越600多人的恐怖份子名單, 當中包括維權人士和反對政府人士。名單於2018年2月21日, 高級助理國家檢察官 Peter Ong代表國家司法機關在馬尼拉的地區法院提交名單,要求法庭確認恐怖分子名單。 該呈請不僅旨在將菲律賓共產黨 – 新人民軍(CPP-NPA)列為恐怖組織,也將個人, 包括組織領袖或成員 (包括那些已死亡、失踪的、或在棉蘭老島被殺的準軍事部隊成員)列為恐怖份子。
這是杜特爾特政府對進步派領袖、愛國組織以及革命力量的惡毒和公然的攻擊。 他們選擇不對杜特爾特「反人民」和可疑的「反對非法毒品和腐敗」政策保持沉默 ,卻被列入恐怖分子名單。區域審判法庭的呈請書試圖在杜特爾特批評者中間播下恐懼,並且同時為實施對整個菲律賓的軍事統治和戒嚴法鋪路。
在阿羅約和阿基諾政權時期,進步組織的成員和領袖、人權與和平倡導者、以及被指投入政治鬥爭的政治運動人士,都被誣告無中生有的罪名、被拘留、遭受酷刑,甚至被殺害。這樣的經驗,對於菲律賓人來說仍然是記憶猶新。 如今這樣的名單,旨在打擊提出土地改革、環境保護、合約化等合法問題的政治和社區異見人士,以前車之鑒,只會加劇和惡化菲律賓的侵犯人權狀況。
在恐怖分子名單中的進步人士包括聯合國土著人民權利特別報告員 Victoria Tauli Corpuz女士。 她同時是聯合國就土著問題常設論壇的前主席。Victoria Tauli Corpuz關注棉蘭老島實施戒嚴的情況及可能因此發生侵犯人權的案件。 她這次被列入名單清楚地表明了杜特爾特政府對她的報復。
恐怖分子名單上,還有積極爭取祖傳領域和自決權的土著人民組織領袖。當中包括,Joan Carling, Atty. Jose Molintas,Beverly Longid,JoannaCariño和Wendell Bolinget,以及棉蘭老島南部和北部至少有10名領導。這些人的人格以及他們對土著人民的鬥爭的承擔不僅得到了許多社區人們的承認,而且在聯合國土著問題常設論壇和國際土著人民運動(IPMSDL)得到肯定。
更甚的是,這個虛假的恐怖分子名單以及地區審判法庭提交的申請,旨在將新人民軍列為恐怖組織。這更揭露了杜特爾特政府在和平談判中的真實意圖。 通過將NDFP 和平委員會的成員如Coni Ledesma,Julie de Lima, Benito 和 Wilma Tiamzon以及其他20名和平顧問和前Bayan Muna. 代表Satur Ocampo 放在恐怖分子名單內, 證明了杜特爾特政府的和平綱領只不過要革命力量投降,而並非真正達到和平談判的目的:「解決菲律賓武裝鬥爭的根源,實現菲律賓人民對土地,就業,正義和人權的渴望」。

- 停止散播恐懼
- 聽取他們對土地、就業、正義和人權的合理訴求
我們相信,假若菲律賓人民的合法訴求得到滿足、人權得到尊重, 政府不再步向專制暴政,他們便不會舉起拳頭批評政府。
